// terms
The agreement between you and me when you use the Bismology apps or this website.
The short version.
Bismology is run by one independent developer based in Ontario, Canada (“I” and “me” below). These terms cover the website at bismology.com and the Bismology apps, Progress XP, Visual Schedule, and Auto Todo, on every platform they run on.
By using the apps or the website, you agree to these terms. If you don't agree, please don't use them.
What you create in the apps belongs to you. You give me permission to store, copy, and transmit it only as far as that's needed to run the apps for you: syncing it between your devices, keeping server backups, and showing it back to you. I don't use it for anything else. The privacy policy explains what I store and why.
You can delete your content, or your whole account, at any time at bismology.com/delete.
When using the apps or the website, please don't:
I may suspend or close accounts that do these things.
I build and run Bismology myself and work to keep it reliable, but I can't promise the apps will always be available, will be free of errors, or will never lose data. The apps and the website are provided “as is” and “as available”. Keep your own backups of anything important, using an app's backup export where it has one.
As far as the law allows, I'm not liable for indirect or consequential losses arising from your use of the apps or the website, such as lost data, lost profits, or lost time. My total liability to you for any claim is limited to what you paid me for Pro in the 12 months before the claim, or $10 USD if you haven't paid anything.
Nothing in these terms takes away rights you have under consumer protection law that can't be waived, including Ontario's Consumer Protection Act, 2002 and the consumer laws of the place where you live.
You can stop using the apps or delete your account at any time at bismology.com/delete.
I may suspend or close an account that breaks these terms. Unless the problem is serious, I'll try to warn you first. If I ever shut down an app or the sync server, I'll give reasonable notice in the app so you have time to export your data.
I may update these terms. The current version is always on this page, with its date below, and significant changes will also be noted in the apps. If you keep using the apps after a change, you're accepting the updated terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be handled by the courts of Ontario, unless the law where you live gives you the right to bring a claim in your local courts.
